UNDER COLOR OF LAW Commentary, by Franklin D. Vipperman, Las Vegas Tribune, 06-05-02, P. 3 Federal law, which supercedes (above all state laws) is always available to you, and you have readily available, access to it. And it's powers! Acting "under color of law" simply means that [anyone] employed by, and/or being paid wages, your tax dollars, through any State or Federal agency, or their State, County, City, Township, are "acting under color of law," in their "official capacities." And if they are breathing, they are acting in their "individual capacities." Consequently, if they are breathing and earning wages from the State or Federal government, they are "acting in their individual and official capacities under color of law." And therefore can be held liable for monetary, declaratory, and injunctive relief for you, through federal court law suits, for their violations of your Constitutional Rights. The United States Codes (U.S.C.) provides for civil rights law suits against any/and or all those "acting under color of law" that are dumb enough to attempt to violate your constitutional rights. And a 42 U.S.C. Section 1983 federal law suit is the best and fastest remedy to punish all those that have/or are dumb enough to attempt to violate your constitutional rights. And, if two or more of those idiots are trying together or have violated your constitutional rights, they become "conspirators" in the action. Thereby "opening the door" on grounds they can be sued under authority of 42 U.S.C. Section 1985(3). And, [all] their pals, buddies, leaders, bosses, higher-ups, whomever, that are aware of them violating your constitutional rights, are equally liable for their knowledge, participation therein, or failure to prevent or stop those others from violating your constitutional rights and can be punished under authority of 42 U.S.C. Section 1986. Therefore, always cite all three U.S. Codes as jurisdiction. You, as an individual, when born in the U.S., were freely given your personal constitutional rights. Which will and can protect you from [all] those others, as long as you are still breathing. Those constitutional rights stay adhered to you, and can be used to protect you, your entire life, regardless wherever you may be within the U.S. And the protection of your constitutional rights do not every leave you, regardless whether you pass through the jail house doors, prison gates or walls, or anywhere else in this entire country. They are yours for your entire life: unless of course, they are stripped from you by a legal and constitutional act of Congress or higher. Which is not very likely to ever happen to you in your lifetime. And [all] that overwhelming power you were born with, and is forever affixed to you, completely surrounds you, and is at your fingers touch, any and all times you need it or want to use it. And you can find it, learn it, use it and make incredible inroads in your life, simply by going to a public, jail or prison library, or hit a few keys on your computer. It's all there free and available to you, and all the books, knowledge, laws, forms, remedies and avenues you can take are at your whimful and/or capricious desires. Therefore, the next time a person simply breathing and acting "under color of law" violates or attempts to violate, your constitutional rights, be it a he, she, cop, prosecutor, judge (State or Federal), court clerk, bailiff, court service officers, politician in any kind of office, mayor, governor, legislator, congressman, senator, and yes even the president, and members of the United States Supreme Court, and/or employee of any jail or prison or employee thereof or employed by and/or being paid through your tax dollars for their jobs, be it State or Federal, show them who they really are, and what they can and cannot get away with doing to you. If you are indigent, and have no funds available to you, it is all free. If you do have funds that are available to you, then it will cost you about $150 for court filing fees. It is all always available to you, at your beckoning touch. And above all, completely forget about and don't waste your hard earned dollars, time and efforts, on a worthless lying attorney that will simply steal your money, properties, and possessions, through lies and empty promises, while he or she sells your legal case down the horrendous sink holes of the overwhelmingly corrupt legal and/or judicial system. You cite and give the federal court jurisdiction (authority to act upon and entertain the action) by invoking the authority of 28 U.S. C. Sections 1343(1)(2)(3)(4). And if you are suing for more than $10,000 dollars, you further invoke jurisdiction for the court to act upon and entertain its powers under the authority of 28 U.S.C. Section 1331(a). Whereby, for all of you millions of people out there that have had the misfortunes of being abused and/or misused by the "hollow powers and authorities of" all those that have taken it upon themselves to violate your constitutional rights, head for the libraries, computers and Federal Court. For those magical instruments can and will undoubtedly improve your lives, beings, and futures and the lives and futures of all those others around you, while making your lives fuller, happier, and much more worth while as you pass through it... | ||
