- You may wish to
contact your State's Attorney General's office to find whether UPL
has been defined in your state or whether any case citations
address the matter.
- You may wish to
contact the State Bar in your State to find whether they have
issued a definitive list of actions considered to be
UPL.
- General
guidelines:
- "Ghost-writing" may be considered UPL; while we may
(according to the laws of each state) be able to hire a
consultant attorney, or to purchase "unbundled" legal services
from an attorney, in general, writing legal documents for
another person may be an UPL violation;
- Changing another
person's motion in order to make it read better, may be an UPL
violation;
- Avoid filling out
another person's legal forms (unless you have a valid power of
attorney, and even then it may be "dicey");
- Give no advice,
advise no actions;
- Do not interpret
laws for another
person.
