TOXIC MATERIAL DISCOVERED AFTER WIFE WASHES WELDER'S CLOTHES

When Jessie Battey's wife died January 26, 2001, he lost a best friend of 22 years.  How she died is what makes every day thereafter a struggle for the former welder.

One of Battey's welding jobs was his participation in building Caesar's Palace Tower number 2.  Tommy Ford was the contractor of record.  Battey's wife died, according to Jessie and several Nevada doctors, of "injuries sustained by shaking out his 'toxic filled clothes'."

In a letter to State of Nevada Senator Raymond D.Rawson, dated November 25, 2001, Jessie Battey told the senator of a toxic material that had been introduced into the lungs of welders as they connected joints, which inadvertently burned a calking used commonly in almost every construction project.

Eventually his wife contracted the toxin in her system as she daily shook out the dust particles in his work clothes before washing them.  This toxic material has since been studied and some investigators say there is proof the toxin is fatal in some cases.

But when Jessie Battey went to his supervisors with the information, he was stiffly told to "keep his mouth shut about the problem."  Further, as he became more ill from breathing the toxic material, as well as his wife, State Industrial Insurance System doctors began a methodic cover-up of the toxic poisoning, which has continued to this day.

According to Jessie Battey, the cover-up was also perpetuated by contractor, Tommy Ford.  In a statement, which Jessie Battey has sent to every federal agency in the country involved in the matter, he said, "The State of Nevada has decided that it is appropriate to murder its' injured and disabled, to avoid paying them 'just compensation' for their injuries.  Nevada's legislature has made laws that allow insurance companies to deny medical care, food and lodging by use of fraud.  The U.S. Supreme Court has found this illegal since it conflicts with federal civil rights laws.  You would believe the Federal Justice Department would explain this to Nevada, but it appears the Justice officials don't care.  We believe that if you or anyone else suffers a catastrophic injury, Nevada's bureaucrats and others will deny you medical care by the use of fraud, effectively murdering you."

In the letter to Sen. Rawson, Battey states, "I continue to believe that had we known about the toxin's danger we could have been treated and recovered within a few weeks.  I also believe Tommy Ford's cover-up of this toxic poisoning is, in fact, murder, and conspiracy to commit murder.  I have no doubt that Tommy Ford will eventually be prosecuted for what he has done, since there is no statute of limitations on these crimes."

In a web site, which Battey designed, intended to inform the public about the "cover-up" he believes has taken place, he stated:  "As far as we can tell Nevada does not recognize civil rights or the rulings of the United States Supreme court.  We hope to change that by showing the world Nevada's criminal behavior.

"We will begin by documenting what we call the Tommy Ford conspiracy.  We believe that this is only one of thousands of similar conspiracies orchestrated by Nevada's bureaucracy and insurance companies.  To begin with, my wife Sandy slowly choked to death after being exposed to toxins by Mr. Ford's conspiracy.  She died January 26, 2001 at 4:00 p.m.

"I intend to show Sandy as the sweet and loving person that she was, she never intentionally hurt anyone, but I believe that Tommy Ford did not consider this when he initiated his conspiracy, that I believe ultimately caused her death.

"We have been trying since June 1997 to get an investigation of a massive poisoning at Caesar's Palace tower No. 2, only to find that Nevada has repeatedly covered up massive poisonings.  Both Nevada Governor Kenny Guinn and Congresswoman Shelley Berkely asked for an investigation but Attorney General Frankie Sue Del Papa refused.  It is probably just as well, since it would most likely be a cover-up anyway.

"When I was first injured, I went to the doctor chosen by Horizon Comp-Care.  I believed they would test me and give me appropriate medical care.  Nothing could be further from the truth.  I soon learned that their job was to prevent me from documenting my injuries.

"After learning that Nevada's State Industrial Insurance System had not reported my injuries to OSHE - Nevada's version of OSHA, I then reported toxic poisoning to OSHE myself, only to find that OSHE supervisor, Ron Parker, also was determined to cover up the truth about the toxic poisoning of possibly hundreds of people.

"I have learned that although Nevada's State Industrial Insurance System's own Doctor, Dr. Craner, found in an investigation for SIIS that people were being poisoned by toxins at the Sawyer Bldg (Nevada's Government Building located in Las Vegas).  He was promptly fired for his findings and the employees of the building were denied medical care and work loss compensation.

"Where was OSHE and its' supervisors, Ron Parker and Danny Evans?  Nevada Attorney for Injured Workers, Lee Davis, told me that if I insisted on telling the truth about how many workers were injured, I would never receive one cent from Nevada's SIIS for my disability."

In an on-going investigation by the Las Vegas Tribune, it may have already been discovered that the same toxic material which permeated Battey's house and allegedly killed his wife, was also present on the documents handed over to Tribune investigators.

One of the reporters became ill from handling the documents and had to have them removed until they could be safely handled.  An investigation into verifying if the dust particles from the toxic materials which came from Battey's home was somehow mixed with something else, or is injurious by itself, is under way.  A series of articles is being planned to investigate the alleged cover-up and the toxic material, which may be a danger to many other Nevada workers.
