PART OF LAWSUIT OVER EYE TROUBLE DISMISSED

A judge on Monday dismissed a portion of a lawsuit brought by a Las Vegas woman who contends that her vision problems are the result of substandard medical care.

Anya Duke, who filed the lawsuit in 1994, said the decision by District Judge Nancy Saitta means she will not be permitted to pursue a claim that she was misdiagnosed when she sought treatment in August 1991 for a black spot in her right eye.

Duke said she will be allowed to pursue her contention that she was afforded substandard medical care.

The case goes to trial August 8.  Defendants include Dr. Roger Simon and Retina Consultants of Nevada.
