NEVADA STATE BAR: MAKING THE LAW WORK FOR EVERYONE By Cindy Little, Tribune Media Group, Published in Las Vegas Tribune, 09-04-02, P. 9 The Motto of the Nevada State Bar is "Making the law work for everyone". And we ask, what do they mean by "everyone?" It seems that the Bar only cares about complaints made by elite citizens. It also seems that they only reprimand a small group of attorneys, and never attorneys with big corporations. According to the Nevada State Bar, you can expect them to treat your complaint with "fairness and dispatch." They claim "The Bar is genuinely concerned about your complaint and will handle it as quickly as possible." Not once do they say that if a person is in prison and his attorney commits malpractice, they will totally ignore the complaint! All lawyers licensed to practice law in Nevada are sworn to uphold the ethical standards of conduct adopted by the Supreme Court of Nevada whether the attorney's client is in prison or not. A good example is the case of Paul Warren Recktenwald. In 1995, Recktenwald was charged with sexual assault with a child under 16 years of age. Paul Recktenwald is now doing time in the Nevada State Prison in Ely for a crime he continuously claims he never committed. He was sentenced to six life sentences. At the time, Recktenwald was represented by Nye County Public Defender, Harry Gensler. The accuser of Mr. Recktenwald was a young woman by the name of Miranda (Mandy) Holmes. Another person who testified against him was ironically, Recktenwald's own fiancee, Anjelique Marker. In 1996, Mandy Holmes called Public Defender Gensler and told him that she had lied under oath. She acknowledged that she lied about the incident between Recktenwald and herself and indicated that her grandmother, and her uncle, Bill Valentine, were the ones who forced her to lie. Mandy also told Gensler that Anjelique Marker lied for her when she testified. As a result of such a confession, Mr. Gensler obviously had to withdraw from the case. Mr. Gensler filed an affidavit to the court stating all the facts of the matter. In November of 2000, Anjelique Marker came forward and, before a court reporter, video cameras, and the press, stated that she had lied in court. She said that Miranda Holmes had threatened her and told her to lie. She said that Paul Recktenwald never committed the crimes he was accused of. Finally, a judge appointed attorney Michael Printy to file a Post-conviction writ. Several months passed and attorney Printy never filed one single document on behalf of Recktenwald. It is very understandable that Mr. Recktenwald was frustrated - it was his life at stake. The case was later assigned to attorney Lewis Taitel. Not a single paper was filed on behalf of Recktenwald. Then attorney Steve Evenson was appointed to Recktenwald's case. The pattern of incompetence continued. Nye County Judge John P. Davis issued an order to show cause, and Evenson was reprimanded. Evenson was replaced and attorney Andrew Fritz was appointed. Attorney Fritz knows that there is a Statute of Limitation to file a Post Conviction Writ on behalf of Mr. Recktenwald, and still he hasn't done a thing about it. His only excuse is that his law clerk is working the case. These are the type matters the Bar Association should be concerned with. The Bar goes after attorneys that spend 100% of their time trying to solve people's problems, but they ignore the misconduct of attorneys that are receiving funds from us, the taxpayers, and do nothing to protect indigent clients from unscrupulous lawyers. If the Nevada Bar Association refuses to take complaints from people in prison, then we are publicly making such a complaint on their behalf specifically against Nevada licensed attorneys Michael Printy, Lewis Taitel, Steve Evenson, and Andrew Fritz. Paul Reckentwald claims he is innocent. His accusers have said they lied. His Public Defender had to withdraw from the case because he heard conflicting testimony from Reckentwald's accuser. Knowing of such information, the prosecutor, Kirk Vitto, refused to withdraw from the case. For God's Sake, this sounds like a personal vendetta! WORKING TOGETHER TO ATTAIN FAIRNESS | ||
